Beach and ERP at A-Basin — Event Legal Notice & Liability Waiver

By registering for, attending, or participating in the Beach and ERP at A-Basin event hosted by Racette Consulting, LLC ("Racette Consulting," "we," or "the Company"), you ("Attendee") acknowledge that you have read, understood, and agree to be bound by the following terms and conditions. If you do not agree to these terms, you should not attend the event.
1. Event Overview
Racette Consulting is hosting a community networking event for customers, partners, and NetSuite users at The Beach at Arapahoe Basin Ski Area in Summit County, Colorado. The event will include networking, food, beverages (including alcohol), hot drinks, and the optional opportunity to ski or snowboard on Arapahoe Basin's mountain terrain.
2. Assumption of Risk
Attendee voluntarily assumes all risks associated with participation in this event, including but not limited to:
2.1 Skiing and Snow Sports
Skiing, snowboarding, and all other snow sports involve inherent risks of serious injury or death. By choosing to ski or snowboard during the event, Attendee expressly acknowledges and assumes all risks associated with such activities, including:
• Falls, collisions with other skiers, snowboarders, or fixed objects
• Variable and unpredictable weather and snow conditions
• Terrain hazards including moguls, ice, cliffs, trees, and groomed and ungroomed runs
• Equipment malfunction or failure
• Actions of other guests, skiers, or resort staff
• Physical exertion and altitude-related health effects
Skiing and ski-related activities are entirely optional. Racette Consulting strongly encourages all Attendees to follow all posted signs, rules, and instructions from Arapahoe Basin Ski Area personnel at all times. Attendees must comply with the Skier Responsibility Code and all resort policies.
2.2 Food and Beverage
Racette Consulting will provide catered food and alcoholic and non-alcoholic beverages during the event. By attending, Attendee acknowledges:
• Alcoholic beverages will be available on-site for guests of legal drinking age (21+)
• Attendees assume personal responsibility for their alcohol consumption and its effects
• Racette Consulting reserves the right to refuse service of alcohol to any Attendee who appears to be intoxicated or is under the legal drinking age
• Attendees with food allergies, dietary restrictions, or medical conditions are responsible for inquiring about ingredients before consuming any food or beverage
• Racette Consulting is not liable for any adverse reactions, illness, or injury related to food or beverage consumption
2.3 Outdoor and Mountain Environment
The event takes place at elevation in a mountain environment. Attendees assume risks associated with:
• High altitude and reduced oxygen levels
• Rapidly changing weather conditions, including cold temperatures, wind, and precipitation
• Uneven terrain, ice, and snow on walkways and outdoor areas
• Sun exposure and UV radiation at high altitude
3. Release and Waiver of Liability
To the fullest extent permitted by applicable law, Attendee hereby releases, waives, discharges, and covenants not to sue Racette Consulting, LLC, its officers, directors, employees, agents, contractors, successors, and assigns (collectively, the "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death occurring in connection with attendance at or participation in the Beach and ERP at A-Basin event, including without limitation:
• Personal injury, illness, or death
• Property damage or loss
• Any and all claims arising from the negligence of the Released Parties
• Any claim relating to the consumption of food or alcohol at the event
• Any claim arising from skiing, snowboarding, or other snow sports activities
• Any claim relating to weather, terrain, or outdoor conditions
This release applies to claims arising from the active or passive negligence of the Released Parties to the extent permitted by law. This release does not apply to claims arising from gross negligence, willful misconduct, or fraudulent misrepresentation.
4. Indemnification
Attendee agrees to indemnify, defend, and hold harmless the Released Parties from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) Attendee's attendance at or participation in the event; (b) any breach of these terms by Attendee; (c) any harm caused by Attendee to third parties or property during the event; or (d) Attendee's violation of any applicable law, regulation, or resort policy.
5. Alcohol Policy
Racette Consulting will serve alcohol responsibly in compliance with Colorado state law. Attendee agrees to the following:
• Proof of age (government-issued photo ID) may be required to receive alcoholic beverages
• Attendees who ski or engage in snow sports assume sole responsibility for ensuring their fitness to do so, including refraining from skiing while under the influence of alcohol or other substances
• Racette Consulting is not responsible for Attendee conduct or any incidents caused by alcohol consumption
• Colorado law prohibits the provision of alcohol to persons under 21 years of age; any Attendee who misrepresents their age assumes full legal responsibility
6. Third-Party Facilities and Activities
The Beach at Arapahoe Basin and the ski mountain are operated by Arapahoe Basin Ski Area, a third party. Racette Consulting does not own, operate, or control the ski resort or its facilities. Attendees who choose to ski must comply with all Arapahoe Basin Ski Area rules, policies, and waiver requirements. Any separate waiver or agreement required by Arapahoe Basin Ski Area must be completed independently by the Attendee. Racette Consulting is not responsible for the actions, omissions, or negligence of Arapahoe Basin Ski Area or its employees.
7. Health and Safety
Attendees are responsible for their own health and physical fitness for participation in this event. Racette Consulting strongly encourages Attendees to:
• Consult with a physician before engaging in skiing or any strenuous physical activity, particularly at altitude
• Stay hydrated and be aware of signs of altitude sickness
• Wear appropriate clothing and protective equipment for outdoor mountain conditions
• Inform event staff of any medical emergencies immediately
Racette Consulting will have a designated point of contact on-site to assist with emergencies. In the event of a medical emergency, please contact Summit County Emergency Services at 911.
8. Photography and Media
By attending this event, Attendee grants Racette Consulting the right to photograph, film, or record the event, and consents to the use of such images or recordings for marketing, promotional, or other business purposes without compensation. If you do not wish to be photographed, please notify a Racette Consulting representative at the event.
9. Limitation of Liability
IN NO EVENT SHALL RACETTE CONSULTING BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR ATTENDANCE AT OR PARTICIPATION IN THIS EVENT, EVEN IF RACETTE CONSULTING HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT PERMITTED BY APPLICABLE LAW, RACETTE CONSULTING'S TOTAL LIABILITY TO ANY ATTENDEE SHALL NOT EXCEED THE AMOUNT, IF ANY, PAID BY THAT ATTENDEE TO REGISTER FOR THE EVENT.
10. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of law principles. Any dispute arising out of or relating to these terms or the event shall be subject to the exclusive jurisdiction of the state and federal courts located in Denver County, Colorado.
11. Severability
If any provision of these terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or severed from these terms if modification is not possible, without affecting the validity or enforceability of the remaining provisions.
12. Acknowledgment
BY REGISTERING FOR OR ATTENDING THE BEACH AND ERP AT A-BASIN EVENT, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THESE TERMS AND CONDITIONS, THAT YOU AGREE TO BE BOUND BY THEM, AND THAT YOU ARE VOLUNTARILY ASSUMING THE RISKS DESCRIBED HEREIN.
